1. Purpose
These Terms of Service (the "Terms") set out the conditions under which any person (the "User") accesses and uses the Retro Pal mobile application (the "Application") and the retropal.fr website (the "Site").
2. Publisher
The Application and the Site are published by a French micro-enterprise whose full contact details are listed on the Legal notice page.
3. Description of the app
Retro Pal is a software emulator that runs, on iPhone, ROM files compatible with the Game Boy, Game Boy Color, Game Boy Advance and Nintendo DS consoles. The Application uses the open-source emulation cores mGBA and melonDS.
The Application contains no games. It does not provide, reference, or make available any ROM file. The User must supply their own files.
4. Intellectual property
The source code of the Retro Pal application is released under the GNU General Public License v3.0 (GPL-3.0). The "Retro Pal" trademark, logo, visual identity, and the graphics and texts of the site and app remain the exclusive property of the publisher and are not covered by that license.
The Application integrates open-source components whose respective licences apply. See the "Third-party software" section at the bottom of this page and the Legal notice page for details.
Any trademark, console name, or game title mentioned on this site is the property of its respective holder and is cited only descriptively, to indicate compatibility of the Application.
5. Use of ROM files (important)
The User is solely responsible for the legality of the ROM files they import into the Application. The publisher of Retro Pal does not supply, distribute, or tolerate the use of ROM files for which the User does not legitimately hold the rights.
Under French law, making a personal backup copy of a video game whose original physical copy you legally own is subject to strict conditions. Downloading ROMs from the internet, even for a game you otherwise own, may constitute counterfeiting. When in doubt, refrain.
The publisher disclaims any liability for the User's use of files they import, and reserves the right to cooperate with competent authorities in case of a claim.
6. Expected User behavior
The User agrees to use the Application in accordance with its intended purpose, not to attempt to decompile, disassemble, or circumvent Apple's technical protection measures, and to comply with the laws applicable in their country of residence and connection.
7. In-app purchases
The Application offers a "Retro Pal Pro" version via two in-app purchase options, processed exclusively by Apple through the App Store / StoreKit service:
- Lifetime purchase: $4.99 (indicative price, subject to variation depending on the Apple price tier), granting access to all Pro features for the lifetime of the Application.
- Monthly subscription: $0.99 per month, auto-renewing, granting access to the same features as long as the subscription is active.
Purchase management (payment, refund, subscription cancellation) is handled exclusively by Apple. The App Store Terms of Service apply. For any payment-related question, see support.apple.com/billing.
The monthly subscription automatically renews at the end of each period unless cancelled at least 24 hours before renewal. Subscription management is done from: iOS Settings → your name → Subscriptions.
8. Limited warranty
The Application is provided "AS IS", without warranty of any kind, express or implied. The publisher does not warrant that the Application will be bug-free, compatible with all ROM files, or continuously maintained. Compatibility with a specific game depends primarily on the mGBA and melonDS emulation cores, over which the publisher of Retro Pal has only limited control.
9. Limitation of liability
To the fullest extent permitted by applicable French law, the publisher shall not be liable for any direct or indirect damages resulting from the use or inability to use the Application, in particular loss of game progress, file corruption, or any damage caused to the device.
The User acknowledges being solely responsible for backing up their important data (in particular via iOS iCloud Backup).
10. Third-party software (open source)
The Application incorporates the following open-source software:
- mGBA, Mozilla Public License 2.0 (MPL-2.0). Source code: mgba.io. Source code not modified.
- melonDS, GNU General Public License v3.0 (GPL-3.0). Source code: melonds.kuribo64.net. Source code not modified.
Retro Pal is itself distributed under the GPL-3.0. The full license texts above are available at the URLs indicated and within the Application, in Settings → Legal Notice & Licenses.
11. Changes to these Terms
The publisher reserves the right to amend these Terms at any time. The current version is always the one available at retropal.fr/en/terms, dated at the top of the page. Any substantive change will be flagged to the User within the Application.
12. Governing law and jurisdiction
These Terms are governed by French law. Any dispute relating to their interpretation or execution shall be submitted to the competent French courts, subject to applicable consumer protection rules.
